«الثقة» من أسمى القيم الإنسانية، وأكثرها حضوراً في العلاقات الاجتماعية، خصوصاً في المجتمعات القائمة تعاملاتها على حسن الظن والتقارب، غير أن الإشكال لا يكمن في «الثقة» نفسها بوصفها قيمة أخلاقية، بل في الإفراط بها، وتحميلها ما لا تحتمله في البيئات التي تحكمها الأنظمة، وتُفصل فيها الحقوق بالأدلة والمستندات.

تكشف الممارسات القضائية أن عدداً غير قليل من النزاعات لم ينشأ عن سوء نية أو خلاف مقصود، بل بعبارة متداولة وبسيطة (بيننا ثقة)، تُقال غالباً بحسن قصد فتتحول عند أول خلاف إلى عبء إثباتي ثقيل.

إن القضاء لا يحكم بالنيات، ولا أن يُقيم وزنه على العلاقات الشخصية أو المعرفة السابقة، وإنما يفصل في النزاع بما هو ثابت ومُثبت نظاماً، وهنا تبرز مفارقة لافتة: (مجتمع يُعلي من شأن الثقة في معاملاته، ومنظومة عدلية لا تعترف إلا بما هو موثَّق).

وغياب التوثيق لا يضعف المراكز القانونية فحسب، بل يفتح المجال لنزاعات كان بالإمكان تفاديها، ويحوِّل علاقات مستقرة إلى خصومات طويلة، لا لخلل في النوايا، بل لسوء تقدير لمكان الثقة وحدودها النظامية.

ولا يقتصر الأثر على الجانب العدلي وحده، بل يمتد إلى البعد الاجتماعي، حيث قد تُمنح الثقة دون وعي بعواقبها، أو تُستغل في غير موضعها، بما يعرِّض الحقوق لمخاطر كان يمكن الحد منها بإجراءات نظامية بسيطة.

ومن هنا؛ تتضح أهمية العدالة الوقائية، وهي العدالة التي لا تنتظر نشوء النزاع لتفصل فيه، بل تسعى إلى منعه قبل وقوعه، عبر تعزيز ثقافة التوثيق، وربط حفظ الحقوق بالإجراءات النظامية لا بالاعتبارات الشخصية وحدها. فالتوثيق لا يُعد نقيضاً للثقة، بل صورتها الأكثر نضجاً، ولا ينتقص من القيم، بل يحميها من أن تتحول إلى سبب للنزاع.

ويبقى التساؤل الأهم: كم نزاعاً كان يمكن ألا يرى النور، لو وُثِّقت الحقوق في وقتها؟

Judicial practices reveal that a considerable number of disputes did not arise from bad intentions or deliberate disagreements, but rather, in simple and common terms (we have trust), which is often said with good intent but turns into a heavy burden of proof at the first disagreement.

The judiciary does not rule based on intentions, nor does it weigh personal relationships or prior knowledge, but rather resolves disputes based on what is established and documented legally. Here, a striking paradox emerges: a society that elevates the value of trust in its dealings, and a judicial system that recognizes only what is documented.

The absence of documentation not only weakens legal positions but also opens the door to disputes that could have been avoided, transforming stable relationships into long-standing conflicts, not due to flaws in intentions, but due to a poor assessment of the place of trust and its legal boundaries.

The impact is not limited to the judicial aspect alone; it extends to the social dimension, where trust may be granted without awareness of its consequences, or exploited inappropriately, exposing rights to risks that could have been mitigated with simple legal procedures.

From here, the importance of preventive justice becomes clear, which is justice that does not wait for disputes to arise to resolve them, but rather seeks to prevent them before they occur by promoting a culture of documentation and linking the preservation of rights to legal procedures rather than solely to personal considerations. Documentation is not the opposite of trust, but rather its more mature form, and it does not detract from values but protects them from becoming a cause for disputes.

The most important question remains: how many disputes could have been avoided if rights had been documented in a timely manner?
